Ratio Decidendi

Directive 93/13/EEC precludes national courts from supplementing a contract, after removal of unfair terms, with general national provisions that are not default rules. The consumer's interest at the time of litigation is decisive, and the consumer's express will prevails regarding contract annulment. Unfair terms cannot be maintained solely because they are favorable to the consumer unless the consumer expressly consents. It is for the national court to determine, under national law, whether the contract can subsist without the unfair term.
