Procedural Posture

Application Under Article 34 ECHR / Judgment After Full Hearing

  1. 1 Whether annulment of the applicant party's registration for regional elections violated Article 3 of Protocol No. 1 to the Convention (right to free elections)
  2. 2 Whether the exclusion of the party list and candidates was arbitrary or disproportionate
  3. 3 Whether the State's interference with internal party procedures was justified

Ratio Decidendi

The Court found that the annulment of the applicant party's registration for the Karelia regional elections was not proportionate to the aims pursued and constituted an unjustified interference with the right to free elections under Article 3 of Protocol No. 1. The authorities' reliance on the distinction between registered and unregistered party members and the submission of an outdated charter did not justify the exclusion of the party list and candidates, as these issues did not amount to substantive violations undermining the democratic process. The measure impaired the very essence of the applicants' electoral rights and was not necessary in a democratic society.
