Procedural Posture

Application for Annulment / Final Judgment

  1. 1 Whether the application for annulment was lodged within the prescribed time-limit under Article 173 EEC Treaty
  2. 2 Whether the applicant had a legal interest in bringing proceedings despite the tendering procedure being concluded
  3. 3 Whether the Commission Decision No 79/187 was vitiated by the same legal defects as Decision No 78/258 annulled in Case 92/78

Ratio Decidendi

The Court held that the application was lodged within the time-limit, as the communication from the German intervention agency did not constitute proper notification of the contested decision. The applicant retained a legal interest in annulment, even if the tendering procedure was concluded, as annulment could form the basis for damages. The contested decision was legally identical to the one previously annulled in Case 92/78, and thus must also be annulled as regards the applicant's tenders.
