Article 4 of Regulation No 1071/68 does not authorize national intervention agencies, after the expiry of the storage period, to recover deposits wrongly released or to impose pecuniary penalties equal to the deposits released. National legislation allowing such recovery is incompatible with Community law, but Member States retain the right and duty to take proceedings against traders who obtained release by fraudulent means.
