Procedural Posture

Human Rights Application / Judgment After Full Hearing

  1. 1 Whether the rerouting of heavy motorway traffic via a road near the applicants’ homes, causing severe nuisance, violated Article 8 of the Convention
  2. 2 Whether the domestic authorities provided a timely and adequate response to the nuisance and environmental harm

Ratio Decidendi

The Court found that the rerouting of heavy motorway traffic via a road unequipped for such use, in close proximity to the applicants’ homes, exposed them to severe and prolonged nuisance (noise, vibrations, air pollution) exceeding statutory norms. The domestic authorities failed to provide a timely and adequate response to the problem, and did not strike a fair balance between the applicants’ rights and the community interest. This constituted a violation of Article 8 of the Convention.
