The cumulative effect of the confidentiality of documents, limitations on access to the case file, and the privileged position of the Commissioner of Public Interest placed an unrealistic burden on the applicant and did not respect the principle of equality of arms, resulting in unfair proceedings contrary to Article 6 § 1 taken together with Article 6 § 3 of the Convention.

Court Disposition

Violation of Article 6 § 1 in conjunction with Article 6 § 3 found; remainder of application inadmissible.

Orders

  • Respondent State to pay applicant EUR 400 in respect of costs and expenses within three months, plus any tax chargeable, to be converted into Polish zlotys at the rate applicable at the date of settlement.
  • From expiry of three months until settlement, simple interest at the marginal lending rate of the European Central Bank plus three percentage points.
