Ratio Decidendi

The Commission was justified in classifying the persistent non-payment of taxes and social security contributions by Magefesa group companies as illegal State aid incompatible with the common market, and in requiring recovery of the aid and interest up to the date of insolvency. However, under Spanish law, interest cannot be recovered after the declaration of insolvency for aid received before that date, and the Commission erred in not excluding such interest from the recovery order.

Court Disposition

Partial annulment; remainder of application dismissed.

Orders

  • Commission Decision 1999/509/EC is annulled insofar as it includes in the amount of aid to be recovered interest falling due after Indosa and Cunosa were declared insolvent on aid unlawfully received before that declaration.
