Procedural Posture

Annulment Action (eu Law) / Final Judgment

  1. 1 Whether Council Regulation (EU) No 1260/2012 infringes the principle of non-discrimination on the ground of language
  2. 2 Whether the delegation of administrative tasks to the EPO violates the principles set out in Meroni v High Authority
  3. 3 Whether Article 4 of the contested regulation lacks a proper legal basis

Ratio Decidendi

The regulation's language arrangements are justified, proportionate, and necessary to achieve the legitimate objective of facilitating access to patent protection and reducing costs, particularly for SMEs. The delegation of administrative tasks to the EPO is consistent with the EPC and does not violate EU law principles. Article 4 is within the scope of language arrangements under Article 118 TFEU. The regulation provides sufficient legal certainty, and the link to the UPC Agreement does not infringe the autonomy of EU law. All pleas are rejected.
