The Court found that the applicant was made to bear an excessive and disproportionate burden by the total deprivation of his disability pension, which he had received for nearly 20 years, as a result of legislative amendments. The measure was not justified by the legitimate community interests relied on by the authorities, particularly as the vast majority of other disability pensioners continued to receive benefits. The interference was discriminatory and failed to strike a fair balance between the general interest and the applicant's rights, resulting in a violation of Article 1 of Protocol No. 1. No separate issue arose under Article 14.
