Ratio Decidendi

Directive 2001/14/EC, particularly Article 4(5) and Article 30, precludes national courts from ruling on state liability claims for overcharged railway infrastructure fees resulting from incorrect transposition unless the regulatory body and, if applicable, the competent court have first ruled on the legality of the charges. However, EU law does not prevent national law from allowing state liability for breaches of EU law under less restrictive conditions than those required by EU law.
