Ratio Decidendi

Sugar in transit between approved warehouses does not fulfill the requirement of storage in a warehouse under Article 3(1) of Regulation No 1358/77. Article 11(1) of Regulation No 1998/78 is legally founded in Article 3(2) of Regulation No 1358/77. The difference in treatment between intra-state and inter-state transit is justified by supervision requirements and does not amount to unlawful discrimination under Community law.
