Ratio Decidendi

The Court found that the Commission infringed KTS's rights of defence by attributing liability for Thyssen Stahl's conduct without giving KTS an opportunity to comment on the acts imputed to Thyssen Stahl. The Commission was not entitled to impose a fine on KTS for acts for which it had not been given a chance to defend itself. The other pleas regarding access to internal documents, formal defects, and errors of assessment were rejected as unfounded. The concerted practice regarding the alloy surcharge constituted an infringement of Article 65(1) ECSC Treaty.

Partial annulment of Commission Decision; applications otherwise dismissed.
