The CJEU held that the General Court did not err in law in finding it manifestly lacked jurisdiction to hear the applicants' action for damages, as the acts and omissions at issue fell within the CFSP, and the Treaties expressly exclude CJEU jurisdiction in such matters except for limited exceptions not applicable here. The mere allegation of fundamental rights breaches does not override the jurisdictional limits set by Article 24(1) TEU and Article 275 TFEU. The exceptions for restrictive measures and Article 40 TEU compliance did not apply to the applicants' claims. The right to effective judicial protection cannot extend CJEU jurisdiction beyond what is provided in the Treaties.
