National rules on doctors' fees and advertising, as applied in this case, do not fall within the material scope of Article 5(3) of Directive 2005/36/EC. It is for the national court to determine if these rules constitute a restriction under Article 56 TFEU and, if so, whether they are justified, appropriate, and proportionate. Article 6(a) of Directive 2005/36/EC does not prescribe the rules of conduct or disciplinary procedures for temporary service providers, but allows for temporary registration or membership to facilitate disciplinary provisions.
