Ratio Decidendi

Hazardous waste may cease to be waste under Directive 2008/98/EC if a recovery operation renders it usable without endangering health or the environment and the holder does not intend to discard it; the REACH Regulation, particularly Annex XVII, is relevant for determining end-of-waste status for CCA-treated wood, and harmonises requirements for its use, with derogations strictly limited to listed uses. The risk of repeated skin contact must be assessed based on the likelihood in normal use, and is for the national court to determine.
