Procedural Posture

Application to the European Court of Human Rights / Judgment on Merits and Admissibility

  1. 1 Whether the non-enforcement of a domestic court judgment violated Article 6 § 1 (right to a fair trial) of the Convention
  2. 2 Whether the applicant had an effective remedy under Article 13 of the Convention
  3. 3 Whether the non-enforcement constituted a violation of Article 1 of Protocol No. 1 (peaceful enjoyment of possessions)

Ratio Decidendi

The Court found that the prolonged non-enforcement of the domestic judgment in favor of the applicant, without justification, violated her right to a fair trial under Article 6 § 1 and her right to peaceful enjoyment of possessions under Article 1 of Protocol No. 1. The compensation awarded domestically was insufficient to provide full redress, and the applicant retained victim status. There was no need to examine Article 13 separately as Article 6 was lex specialis.
