Ratio Decidendi

Article 47 of the Charter, read with Article 9(2) and (4) of the Aarhus Convention, precludes national procedural law that allows an administrative procedure for authorisation of a project on a protected site to be definitively concluded before judicial review of refusal to grant party status to an environmental organisation, and that dismisses such actions automatically after authorisation, thereby requiring the organisation to bring a separate action to secure judicial review of compliance with Article 6(3) of Directive 92/43.
