Reference for a Preliminary Ruling / Opinion of Advocate General

  1. 1 Whether Article 9(3) of the Aarhus Convention has direct effect within Member States' legal orders
  2. 2 Whether Article 9(3) of the Aarhus Convention is directly effective as a matter of EU law
  3. 3 Whether 'act of a public authority' in Article 9(3) includes administrative decisions

Ratio Decidendi

It is for national courts to determine whether Article 9(3) of the Aarhus Convention has direct effect within their legal order, as the EU has not legislated to incorporate that provision into EU law regarding Member States' obligations. Article 9(3) does not have direct effect as a matter of EU law because it is not sufficiently clear and precise and is subject to national criteria. The term 'act of a public authority' in Article 9(3) includes administrative decisions, and public access to judicial review includes the right to challenge such decisions under national law relating to the environment.

Court Disposition

Reference partially admissible; national courts must determine direct effect of Article 9(3); Article 9(3) not directly effective under EU law; 'act of a public authority' includes administrative decisions.

Orders
