Ratio Decidendi

Article 3a(1)(b) of Directive 84/450/EEC does not preclude comparative advertising of food products based solely on differences in consumer preference, production, ingredients, or producer, provided the products are sufficiently interchangeable. Article 3a(1)(a) allows that such advertising may be misleading if consumers are led to believe the selection is representative or if significant differences are omitted. Article 3a(1)(c) requires that the goods compared must be identifiable from the advertisement for verifiability.
