Ratio Decidendi

A project such as the creation of a waste management system in a specific region, implemented over several years and financed by EU resources, falls within the concept of a 'multiannual programme' under Article 3(1) of Regulation No 2988/95. The limitation period for irregularities runs from the date the irregularity was committed or ceased (if continuous or repeated), but in any case, for multiannual programmes, it runs until the programme is definitively terminated, which is the end date indicated in the Commission decision approving the project, unless extended by a new decision.
