While the interference was prescribed by law and pursued legitimate aims, the lack of effective judicial review or access to court for the applicant to challenge the measure rendered the interference disproportionate and not necessary in a democratic society. The applicant was denied an effective remedy and access to court, in violation of Article 8 (and Article 13 in conjunction).
