The applicant's prolonged detention in a police cell while acutely mentally ill, without access to appropriate psychiatric treatment, diminished his human dignity and amounted to degrading treatment under Article 3, despite the absence of intent to humiliate and efforts by authorities. However, the existence of a domestic remedy capable of addressing the substance of his complaint and granting relief satisfied Article 13, even though the outcome was unfavourable to the applicant.
