Procedural Posture

Preliminary Ruling (reference for Interpretation) / Final Judgment of the Court of Justice of the European Union

  1. 1 Whether a national authority may classify a product as a medicinal product by function based on scientific knowledge of a structural analogue when no direct studies exist for the substance in question
  2. 2 Whether a product that modifies physiological functions but has no health-promoting effect can be classified as a medicinal product by function under Directive 2001/83/EC

Ratio Decidendi

A national authority may classify a product as a medicinal product by function under Article 1(2)(b) of Directive 2001/83/EC by relying on scientific knowledge relating to a structural analogue, if the analogy is sufficiently strong and objectively substantiated. Furthermore, a product that modifies physiological functions may only be classified as a medicinal product if it has specific health-promoting effects; improvement in appearance alone is insufficient unless it treats a recognised pathological condition.

Court Disposition

Questions answered; interpretation of Directive 2001/83/EC provided.
