Ratio Decidendi

Chapter V of Regulation 2017/459, which imposes obligations on transmission system operators to create incremental capacity, exceeds the powers conferred on the Commission by Regulation No 715/2009. The power to adopt network codes under Article 8(6) of Regulation No 715/2009 does not extend to rules imposing investment obligations for incremental capacity, which the legislature reserved to Member States. Therefore, the Board of Appeal's decision applying Chapter V is unlawful and must be annulled.
