The Court found that the Russian authorities failed to conduct an effective investigation into Ms Eneyeva's death and ill-treatment, constituting violations of the procedural limbs of Articles 2 and 3. The State also failed to safeguard Ms Eneyeva's right to life while in custody, violating the substantive limb of Article 2. The injuries sustained by Ms Eneyeva were attributable to State agents, amounting to inhuman and degrading treatment in violation of the substantive limb of Article 3. The investigation into both her death and ill-treatment was neither prompt nor effective. There was no need to examine the Article 13 complaint separately.
