EU law, in particular the principle of effectiveness, precludes national legislation that makes bringing an action for damages for infringement of public procurement law subject to a prior finding of unlawfulness, where the declaration of unlawfulness is subject to a six-month limitation period starting from the day after contract award, regardless of whether the applicant knew of the infringement, as this renders the exercise of the right to damages impossible or excessively difficult.
