The Court held that Azerbaijan's declaration purporting to exclude responsibility for occupied territories is invalid under Article 57 and does not restrict the Convention's territorial application. The presumption of jurisdiction over national territory may be rebutted only in exceptional circumstances, which must be assessed on the facts. The Court found insufficient information to rule on jurisdiction and responsibility at this stage and joined the issue to the merits. The Court also held that if the deprivation of property and home is based on an invalid legal act or ongoing de facto situation, it may constitute a continuing violation, thus falling within its temporal jurisdiction....
