The principle of equal treatment does not preclude a contracting authority from requesting, after the application deadline, documents describing a candidate’s situation (such as a published balance sheet) that can be objectively shown to pre-date the deadline, provided the contract documents did not expressly require rejection for failure to submit such documents with the application and the request does not unduly favour or disadvantage any candidate.
