The mere presence of residues of transgenic protein in novel foods does not preclude a finding of substantial equivalence under Article 3(4) of Regulation No 258/97, nor does it automatically bar use of the simplified procedure, unless a risk to human health can be identified on the basis of available scientific knowledge at the time of assessment. Member States may invoke the safeguard clause in Article 12 to suspend trade in such foods only if they have detailed grounds, based on a risk assessment, for considering that the foods endanger health or the environment.
