Article 8(3) of Directive 91/414/EEC does not apply to first authorisation applications under Article 8(2); Member States are not obliged to assess such applications in accordance with Article 4(1)(b)(i)-(v) and (c)-(f). During the transitional period, Member States may continue to apply previous national rules concerning data requirements for active substances not listed in Annex I.
