Ratio Decidendi

A non-EU spouse of an EU citizen must be lawfully resident in a Member State when moving to another Member State to benefit from Article 10 of Regulation No 1612/68. Marriage of convenience to circumvent entry and residence provisions is excluded from such rights. Genuine marriages are not tainted by the intention to benefit from Community law rights upon return. Where the spouse is not lawfully resident, authorities must consider the right to respect for family life under Article 8 ECHR.
