Procedural Posture

Reference for a Preliminary Ruling / Judgment of the Court of Justice of the European Union (second Chamber)

  1. 1 Whether EU law precludes a national provision restricting freedom of movement solely due to an unsecured private debt
  2. 2 Whether EU law precludes national legislation limiting the reopening of final administrative acts that are contrary to EU law

Ratio Decidendi

EU law precludes national provisions that restrict the freedom of movement of a Union citizen solely on the ground of an unsecured private debt, as such restrictions are not justified under the public policy exception and are disproportionate. Furthermore, EU law precludes national legislation that prevents the reopening of final administrative acts which are clearly contrary to EU law, where such acts continue to produce legal effects.

Court Disposition

Reference answered; national provisions precluded by EU law.

Orders

  • EU law precludes the application of a national provision imposing a restriction on freedom of movement solely due to an unsecured private debt.
  • EU law precludes national legislation that limits the reopening of final administrative acts contrary to EU law to exhaustively listed circumstances, where such acts continue to produce legal effects.
