The Board of Appeal erred by failing to assess all relevant circumstances, including the effect of the contested mark on the value and enforceability of the earlier pledged marks and the possible knowledge and economic links between the parties. These omissions meant the Board of Appeal could not properly determine whether the registration was in bad faith under Article 52(1)(b) of Regulation No 207/2009. The decision was therefore annulled.
