Ratio Decidendi

Directive 2004/35/EC applies to environmental damage occurring after 30 April 2007, even if caused by facilities authorised before that date. National law cannot exclude such damage from the Directive's scope solely because it is covered by an authorisation, unless the derogation in Article 4(7) of Directive 2000/60/EC applies. National courts are not required to assess compliance with Article 4(7) if the competent authority did not do so. Persons holding fishing rights must be entitled to initiate review procedures regarding environmental damage under the Directive.
