Ratio Decidendi

The term 'holding' covers all agricultural production units subject to a lease, regardless of presence of dairy cows or technical facilities or lease obligations for milk production. Article 5(3) of Commission Regulation No 1371/84 applies to surrender of leased agricultural units upon lease expiry, even absent dairy cows or milk production facilities. Community rules must be applied in accordance with fundamental rights, allowing compensation or retention of reference quantities by departing lessees when justified.
