Procedural Posture

Application Under Article 34 ECHR / Judgment by Chamber of the European Court of Human Rights

  1. 1 Whether the applicant was subjected to inhuman or degrading treatment by police in April 2005
  2. 2 Whether the investigation into the applicant's allegations of ill-treatment was effective
  3. 3 Whether the applicant received adequate medical assistance while in detention

Ratio Decidendi

The applicant suffered injuries after arrest for which the State failed to provide a plausible alternative explanation, and no adequate medical examination was conducted upon arrival at the police station. The investigation into his complaints was superficial and ineffective. There was a violation of Article 3 under both substantive and procedural limbs. The claim regarding inadequate medical assistance was rejected as manifestly ill-founded due to lack of substantiating evidence.

Court Disposition

Violation of Article 3 (substantive and procedural limbs); partial award for non-pecuniary damage; other claims inadmissible or dismissed.
