Ratio Decidendi

Article 3 of Directive 2009/103/EC precludes national legislation that allows exclusion from compulsory insurance cover for injuries and damage resulting from the use of motor vehicles on roads or terrain not suitable for motor vehicles, except where such terrain is ordinarily so used. The concept of 'use of vehicles' is an autonomous EU law concept and covers any use consistent with the normal function of the vehicle, irrespective of the terrain.
