Ratio Decidendi

Article 11(1)(d) of Directive 2003/109/EC precludes national or regional law that provides, regarding the grant of housing benefit, for different treatment for third-country nationals enjoying long-term resident status compared to nationals residing in the same province or region, when such benefit falls within the categories referred to in that provision and Article 11(4) does not apply. The discrimination alleged does not fall within Directive 2000/43/EC. Article 6(3) TEU does not require national courts to directly apply the ECHR in case of conflict with domestic law.
