Article 267 TFEU obliges national courts to refer questions to the Court of Justice even when bound by higher court rulings. Directive 96/61 requires public access to urban planning decisions from the start of the authorisation procedure; commercial confidentiality cannot justify refusal. Procedural flaws in public participation may be rectified at second instance only if all options remain open and effective participation is possible.
