Ratio Decidendi

Azerbaijan's failure to provide an effective legal and administrative framework to allow the applicant to return to his property in Gulistan or to obtain compensation for its loss, and to access his home and relatives' graves, constitutes continuing violations of Article 1 of Protocol No. 1 and Article 8. The absence of effective remedies for these violations breaches Article 13. No violation of Article 14 was found as the applicant did not substantiate discriminatory treatment beyond the general context of the conflict.
