Ratio Decidendi

Article 3 of Regulation No 2175/88, setting a weighting of 100 for pensions of retired persons residing in non-member countries, is incompatible with Article 82(1) of the Staff Regulations, which entitles pensioners to the weighting fixed for their country of residence. The regulation was adopted without following the procedure for amending the Staff Regulations and is therefore unlawful. The applicant is entitled to the weighting fixed for Switzerland and to default interest on arrears due.

  • Annuls the applicant's pension statement for December 1993 in so far as it applies a weighting of 100.
  • Orders the Commission to pay the applicant default interest at the rate of 8% per annum on arrears of pension, calculated from the dates amounts should have been paid until actual payment.
