Ratio Decidendi

The Polish courts failed to adequately consider the applicant's lack of consent for the children's permanent retention in Poland and did not apply the law of the children's habitual residence (Switzerland) as required by the Hague Convention. The decision-making process lacked procedural safeguards, notably the applicant was not notified or heard regarding the interim custody order. The delay in proceedings was unjustified. These failures resulted in the respondent State not securing the applicant's right to respect for his family life under Article 8.
