The blanket ban on prisoner voting imposed by section 3 of the Representation of the People Act 1983 and extended to European elections by section 8 of the 2002 Act constitutes a general, automatic and indiscriminate restriction incompatible with Article 3 of Protocol No. 1. The applicants had no effective remedy as required by Article 13, as a declaration of incompatibility does not provide redress or damages and further domestic remedies offered no reasonable prospect of success.
