The Court held that the mere reopening of proceedings by way of supervisory review did not provide sufficient redress to deprive the applicant of victim status. The subsequent appeal hearing failed to provide effective legal assistance, as the applicant had no meaningful opportunity to consult with his lawyer and was only able to participate by video link, which in the circumstances did not ensure a fair trial. There was a violation of Article 6 §§ 1 and 3 (c) of the Convention.
