Article 6 (civil limb) applies only where the applicant has a substantive civil right under domestic law, actively pursues it in the criminal proceedings, and the criminal process is decisive for that right. In this case, only the third applicant met these requirements by formally seeking civil party status. However, the discontinuance of the criminal proceedings was not solely or decisively due to judicial dysfunction, and the third applicant did not diligently pursue his claim. All applicants retained the possibility to bring separate civil proceedings. Therefore, there was no violation of Article 6 § 1.
