Ratio Decidendi

The Board of Appeal erred in finding similarity and likelihood of confusion for 'products and preparations for the breeding of birds, reptiles, amphibians' in Class 31 and 'veterinary, therapeutic, disinfecting and sanitary products and preparations for use in terraristics' in Class 5, as the relevant factors did not establish sufficient similarity. For other goods, the Board of Appeal correctly found similarity and likelihood of confusion. Peaceful coexistence was not proven to be based on absence of confusion and did not affect the assessment.

  • Annuls the Board of Appeal decision of 14 February 2017 in so far as it upheld invalidity for 'products and preparations for the breeding of birds, reptiles, amphibians' in Class 31 and 'veterinary, therapeutic, disinfecting and sanitary products and preparations for use in terraristics' in Class 5.
  • Dismisses the appeal by Aviário Tropical, SA, against the Cancellation Division decision of 15 July 2013 in so far as it sought annulment for those goods.
