Refusal to grant WBA to widowers between 1994 and 2000 was unjustified discrimination on grounds of sex contrary to Article 14 ECHR taken with Article 1 of Protocol No. 1, as the difference in treatment was not objectively justified after the introduction of independent taxation. However, no pecuniary or non-pecuniary damages were awarded because the allowance was an unjustified anomaly, and just satisfaction did not require 'levelling up' by awarding the value of the abolished benefit.
