Ratio Decidendi

The Court found that the restriction of the first applicant’s parental authority was not based on sufficient and relevant reasons, as the domestic courts relied on the applicant’s mental disability and the mother’s legal incapacity without establishing a real danger to the child. The courts failed to consider less restrictive alternatives or the possibility of gradual reunification with support. The interference was not necessary in a democratic society and violated Article 8 of the Convention.

Orders

  • The Russian Federation is to pay the applicants, within three months, EUR 5,000 in respect of non-pecuniary damage, plus any tax that may be chargeable.
