Ratio Decidendi

The right to join an occupational pension scheme falls within Article 119 EEC and is subject to the prohibition of sex discrimination; the temporal limitation in Barber does not apply to scheme membership, and both employers and pension fund administrators are bound by Article 119. Retroactive membership does not exempt the worker from paying contributions, and national limitation periods may apply provided they do not undermine Community law rights. Protocol No 2 does not affect the right to join a scheme.
