Community law does not preclude a national rule limiting retroactive payment of incapacity benefits to one year before the claim date, even where the directive conferring equal treatment was not yet properly transposed, provided the rule does not render exercise of rights impossible or excessively difficult. Article 4(1) of Directive 79/7/EEC does not preclude a national provision withdrawing incapacity benefits from women upon award of a widow's pension if, in practice, the provision is applied equally to widows and widowers.
